Obama’s 2012 recess appointments of several members of the National Labor Relations Board (NRLB) was declared unconstitutional by the D.C. Circuit Court of Appeals recently. The president has power to make recess appointments when the Senate is not in session, but the Senate was in session during that time. Obama unilaterally decided that he was the person who could determine when the Senate was in session.
